How to buy property in Bulgaria

1. Could a foreigner purchases a land in Bulgaria or only a building?
2. Could a foreign company purchase a building and a land?
3. Would a foreigner need to establish a company or to register an office in Bulgaria?

In accordance with our Civil law a foreigner or a foreign company can possess ownership of a building and have limited ownership rights on a plot of in Bulgaria . This applies also to the case when a foreign ndividual or a foreign business, inherits land as a legacy. In conformity with the Bulgarian law of succession, the individual or company must transfer ownership to a Bulgarian citizen no later then 3 years after inheriting the legacy.

Foreign company can possess every kind of a land. But it has to be paid attention to the most important fact this land is not allowed to be agricultural. Bulgarian civil law makes no provision for purchasing a building.

The situation for non juridical person - physical/private persons - is slightly different - the foreigner has to buy the right to use a land.

The right to use is one of the 3 elements of the ownership. If the owner doesn't have this element of the ownership he can't sell his property. He will have the need of a special permission which have to be given from the owner of the right to use the same property.

For establishing a company here in Bulgaria the foreigner will have the need of permission for residence in Republic of Bulgaria.

Foreign company can purchase a building and a land but the land is not allowed to be for agricultural needs.
